1. Acceptance of the Terms

Welcome to MOVE. By accessing and using the moveyow.com website (the "Site") and our electric mobility services, you agree to comply with and be bound by these Terms of Service (the "Terms").

If you do not agree to these Terms, you must not use our Site or our services. MOVE reserves the right to modify these Terms at any time, and such modifications will take effect immediately upon posting on the Site.

2. Definitions

  • "MOVE" refers to the electric mobility company operating under the MOVE brand in Mexico and Colombia.
  • "Services" includes all services offered by MOVE: Purchase, Leasing, and Fleet as a Service / Rental (FaaS).
  • "Customer" refers to any company or individual using our services.
  • "Vehicles" refers to the electric vehicles marketed by MOVE: RAP Move Light, RAP Move XL, RAP Move Cold Box, IONAx Move, IONAx Move Cold Box, and IONAx Move Pick Up.

3. Description of Services

3.1 Purchase

The Customer acquires full ownership of the electric vehicle through a one-time payment or approved financing. MOVE provides a warranty as specified in the sales contract.

3.2 Leasing

The Customer leases the vehicle through monthly payments over a fixed term. The service includes preventive and corrective maintenance as set out in the contract. At the end of the term, the Customer may choose to purchase the vehicle, renew the contract, or return the vehicle.

3.3 Fleet as a Service / Rental (FaaS)

A comprehensive solution that includes vehicle, energy, maintenance, and fleet management at a cost per kilometer driven. MOVE retains ownership of the vehicle and assumes full operational responsibility.

4. Customer Obligations

By using our services, the Customer agrees to:

  • Provide truthful, accurate, and complete information during the quoting and contracting process
  • Use the vehicles in accordance with the manufacturer's technical specifications and recommendations
  • Make the agreed payments on time and in full
  • Immediately report any damage, malfunction, or accident
  • Allow scheduled inspections and maintenance as agreed
  • Not modify the vehicles without MOVE's prior written authorization
  • Comply with all laws and regulations applicable to the use of electric vehicles

5. MOVE's Obligations

MOVE agrees to:

  • Deliver vehicles in optimal operating condition
  • Provide technical support and after-sales service
  • Honor the warranties specified for each service model
  • Maintain the availability of spare parts and technical service
  • Respect the confidentiality of Customer information
  • Give reasonable advance notice of significant changes to the services

6. Prices and Payments

Prices for our services are provided through a personalized quote and are subject to:

  • Prices expressed in the currency of the country where the service is provided (MXN in Mexico, COP in Colombia)
  • Applicable taxes under local legislation
  • The specific conditions of the signed contract
  • Possible adjustments for inflation or regulatory changes (notified in advance)

Overdue payments will accrue late-payment interest at the applicable legal rates. MOVE reserves the right to suspend services for non-payment.

7. Warranties

MOVE offers warranties according to the contracted service model:

  • Purchase: Manufacturer's warranty plus optional extended warranty
  • Leasing: Maintenance included for the duration of the contract
  • Fleet as a Service / Rental (FaaS): Comprehensive maintenance and unit replacement in the event of major failure

Warranties do not cover damage caused by misuse, negligence, accidents, or unauthorized modifications.

8. Limitation of Liability

To the maximum extent permitted by law:

  • MOVE will not be liable for indirect, incidental, special, or consequential damages
  • MOVE's total liability will not exceed the amount paid by the Customer in the last 12 months
  • The Customer is responsible for adequately insuring the vehicles
  • MOVE does not guarantee uninterrupted availability of charging services or electric power
  • The Customer assumes responsibility for the safe and lawful use of the vehicles

9. Intellectual Property

All Site content, including text, graphics, logos, images, software, and design, is the property of MOVE or its licensors and is protected by intellectual property laws.

Reproduction, distribution, modification, or commercial use of the content without MOVE's prior written authorization is prohibited.

10. Termination

MOVE may terminate or suspend access to the services immediately, without prior notice, if the Customer:

  • Breaches these Terms of Service
  • Fails to make the agreed payments
  • Uses the vehicles in an illegal or dangerous manner
  • Provides false or misleading information

The Customer may terminate the service as stipulated in the specific contract, subject to the applicable notice periods and penalties.

11. Force Majeure

MOVE will not be liable for failures to perform caused by circumstances beyond its reasonable control, including natural disasters, wars, pandemics, strikes, power outages, third-party infrastructure failures, or government restrictions.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of:

  • Mexico: the Código de Comercio and Código Civil Federal (Commercial Code and Federal Civil Code) for contracts in Mexican territory
  • Colombia: the Código de Comercio and Código Civil Colombiano (Commercial Code and Colombian Civil Code) for contracts in Colombian territory

Any dispute will be resolved in the competent courts of the country where the contract is performed, unless the specific contract provides for arbitration.

13. Modifications

MOVE reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Site. Continued use of our services after posting constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with any signed service-specific contract, constitute the entire agreement between MOVE and the Customer regarding the use of our services.
